Terms of Service

These terms are an agreement between you and [Company Legal Name] ("Instaclones", "we", "us") governing your use of the Instaclones service. By creating an account or using the service you accept them.

The service

Instaclones generates videos from your prompts and media using AI providers and rendering services. Features, quotas, and providers may change as the service evolves. We may modify or discontinue features with reasonable notice for paid functionality.

Your account and workspace

• You must provide accurate information and keep your credentials secure. You are responsible for activity under your account.
• Workspace owners control membership. Inviting someone gives them access to the workspace's content according to their role.
• You must be at least 16 years old (or the age of digital consent where you live).

Your content and likeness rules

• You keep ownership of everything you upload and of the videos generated for you. You grant us the limited license needed to store, process, and render that content — including passing it to the processors that do the generation — solely to provide the service to you.
• Likeness consent is mandatory. Only upload photos or voice recordings of yourself, or of people who have given you explicit permission for AI avatar and voice generation. Creating avatars or cloned voices of someone without their consent is prohibited and grounds for termination.
• You are responsible for having the rights to all media you upload (footage, music, logos) and for how you use the generated videos, including complying with each platform's rules and any AI-disclosure requirements when you publish.

Acceptable use

You may not use Instaclones to create or distribute:

• deceptive impersonations of real people, or deepfakes presented as genuine;
• fraud, scams, or misleading advertising;
• sexual content involving minors, or non-consensual sexual imagery of anyone;
• harassment, incitement of violence, or unlawful content of any kind;
• content that infringes others' intellectual property or privacy rights.

You also may not resell the service, probe or disrupt its security, or use another tenant's data. We may suspend or terminate accounts that violate these rules.

Plans, billing, and cancellation

• Paid plans bill in advance through Stripe on a recurring basis until cancelled. Video quotas reset each billing cycle and unused quota does not roll over.
• You can cancel anytime from the Billing page; access continues to the end of the paid period. Except where the law requires otherwise, payments are non-refundable.
• If a renewal payment fails we will notify you and retry; continued failure downgrades the workspace to the free tier.
• Prices may change with at least 30 days' notice, taking effect at your next renewal.

Third-party platforms

Publishing to YouTube, TikTok, Instagram, or Facebook uses your own connected accounts and is subject to those platforms' terms. We act only on your instruction, and we are not responsible for platform decisions such as removals or account restrictions.

Disclaimers

The service is provided "as is" without warranties of any kind. AI-generated content can be inaccurate or imperfect — review your videos before publishing them. We do not guarantee uninterrupted availability, though we aim for it.

Limitation of liability

To the fullest extent permitted by law, [Company Legal Name] is not liable for indirect, incidental, or consequential damages, and our total liability for any claim is limited to the amount you paid us in the twelve months before the claim arose.

Termination

You may delete your account at any time from the account page, which permanently erases your data as described in the Privacy Policy. We may suspend or terminate accounts that violate these terms, with notice where practicable.

Governing law and changes

These terms are governed by the laws of [State/Country]. We may update these terms; material changes will be announced by email and take effect no sooner than 14 days after notice. Continued use after that constitutes acceptance.
